Des Plaines Swimming Photography Policy August 2009
By signing up for the
Des Plaines River Racers Swim Team, you accept the Photography/Digital Media Policy as stated below. You may terminate that
acceptance by returning this form signed indicating that you do not agree with the terms. Once on record, coaches will take
necessary steps to avoid capturing associated participants in photos or digital images.
Photo Release/Agreement
Des Plaines
Swimming and the Des Plaines River Racers Swim Team utilize photographs, video, and other media means to publicize and market our
programs. In that, we submit press releases and photos to area newspapers, posting on our website, along with displays that
may be presented to others.
The Des Plaines River Racers Swim Team has permission to use photograph or photographic images
of swimmers, staff, and other related members in official Club business, including: Club Web sites, Club newsletters and newspapers,
etc.
It is understood that Des Plaines Swimming’s Board of Directors requires that all swimmers sign off when they register
for the program that they have agreed to pose for a photograph for use in the promotion of Des Plaines Swimming, Des Plaines River
Racers, Maine West High School and its departments/units. It is agreed that the use of photograph or photographic image shall
in no way be used in any other forum other than for official Club business.
In consideration of the engagement as a model, and
for other good and valuable consideration herein acknowledged as received, participants, parents, etc. hereby grant to Des Plaines
Swimming and assigns, those acting with its authority and permission, the irrevocable and unrestricted right and permission to copyright,
in its own name or otherwise, and use, re-use, publish, and re-publish photographic portraits or pictures of members or which members
may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations,
in conjunction with my own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium at his studios
or elsewhere, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or
any other purpose whatsoever. Members also consent to the use of any printed matter in conjunction therewith.
Members hereby
waive any right that they may have to inspect or approve the finished product and the advertising copy or other matter that may be
used in connection therewith or the use to which it may be applied. They hereby release, discharge, and agree to save harmless Des
Plaines Swimming and assigns, and all persons acting under its permission or authority or those for whom acting from any liability
by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that
may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof,
including without limitation any claims for libel or invasion of privacy. Members do hereby release, acquit and forever discharge
the Des Plaines Swimming, its officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause
of action and/or judgments of whatsoever nature of character, past or future, known or unknown, whether in contract or in tort, whether
for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or
to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use
of my photograph or photographic image for official Club business.
This release contains the entire agreement between the parties
and shall be binding upon and inure to the benefit of the successors and assigns of the undersigned.

If
you do not agree to the terms, you must provide this document, signed and dated, to the Des Plaines Swimming Board of Directors. Every attempt will be made to prevent the capture and/or transmission of digital media of the listed participants with whom
you are denying the ability to be photographed. We will not make any guarantees that there NEVER be an image captured, however
we do apologize in advance if it happens. We will attempt to take any and all steps necessary to prevent further transmission.
